In June and July of this year, the U.S. Supreme Court issued a trio of decisions fundamentally altering the long-standing legal principles that have applied to the federal administrative agencies for decades. In Loper Bright Enterprises v. Raimondo, the Court overturned the Chevron doctrine, which afforded federal agencies deference in their interpretations of ambiguous statutory provisions. In Corner Post, Inc. v. Board of Governors, the Court opened the door to additional legal challenges in clarifying when the six-year statute of limitations for seeking judicial review of certain final agency actions begins to run under the Administrative Procedure Act. Finally, in SEC v. Jarkesy, the Court held that the right to seek a jury trial under the Seventh Amendment applies in certain circumstances where a federal agency is seeking to obtain civil penalties for a violation. The American Public Gas Association is pleased to host a webinar on August 6 at 1 pm ET with three attorneys from Babst Calland, who will discuss the implications of these recent Supreme Court decisions for the natural gas industry. Topics to be discussed will include the new framework for determining the extent of a federal agency’s statutory authority, the ability to challenge the exercise of that authority before federal agencies and in the federal courts, and the role of administrative proceedings in actions to enforce federal statutes and regulations, particularly those that involve civil penalties.
